I. General Provisions
Onyx4you.com is an online store, available at onyx4you.com, run by Joanna Kołodziejczyk Onyx 4 You, who can be contacted by customers at the following email address: contact@onyx4you.com
Sales are conducted via the Internet between the person placing an order in the onyx4you.com online store, hereinafter referred to as the Customer, and Joanna Kołodziejczyk Onyx 4 You, hereinafter referred to as the Seller.
The buyer may be any natural person, legal person, or organizational unit without legal personality, registered in the online store. The terms Buyer and Customer used in these regulations are synonymous.
Every Customer purchasing products offered by Joanna Kołodziejczyk
Onyx 4 You is obliged to read the terms and conditions.
II. Subject of Sale
The subject of sale are products presented on the website of the online store onyx4you.com
All products offered in the onyx4you.com online store are brand new, free from physical and legal defects, and have been legally introduced to the Polish market. However, the Seller reserves the right to offer sale items, which will be appropriately marked and described.
The seller is obliged to deliver goods free from defects in accordance with the provisions of Articles 556 and 5561-5563 of the Act of April 23, 1964, Civil Code (i.e. Journal of Laws 2014, item 121, as amended).
The prices of all products presented on the website of the onyx4you.com online store are expressed in Polish zlotys and include VAT. The gross price of the product does not include shipping costs.
The Seller updates the offer of its products presented on the website of the onyx4you.com online store on an ongoing basis.
Payment for the order is made in one of the following ways:
• by bank transfer to the Seller's bank account before delivery of the goods (prepayment)
• cash on delivery, payment upon receipt of the shipment from the courier,
• by debit or credit card
By accepting the Terms and Conditions, the Customer purchasing the offered products agrees to the Seller issuing and sending invoices in electronic form in accordance with the Regulation of the Minister of Finance of July 14, 2005, on issuing and sending invoices in electronic form, as well as storing and making these invoices available to the tax authority or tax inspection authority (Journal of Laws 2005, No. 133, item 1119) and the rules for issuing, sending, and storing electronic invoices. Consent to receive invoices in electronic form is tantamount to waiving the right to receive invoices in paper form.
The Customer's acceptance does not exclude the right of Joanna Kołodziejczyk Onyx 4 You to issue and send invoices in paper form.
The Seller issues and sends invoices in electronic form, guaranteeing the authenticity of their origin and the integrity of their content.
The Customer is entitled to withdraw their consent in accordance with § 3(4) of the Regulation by means of a written statement of intent sent to the following address: Joanna Kołodziejczyk Onyx 4 You, ul. Racławicka 44, 34-125 Sułkowice, Poland, or electronically to the following address: contact@onyx4you.com. In the event of withdrawal of acceptance, from the day following the date of delivery of the Customer's statement of withdrawal of acceptance, Joanna Kołodziejczyk Onyx 4 You loses the right to issue and send invoices to the Customer in electronic form.
III. Order fulfillment
Orders in the online store can be placed via the website (online store). To do so, you must register a user account on the onyx4you.com website and accept the provisions of these Terms and Conditions. It is also possible to make a purchase without registering.
A registered user has the option to:
• make purchases in the onyx4you.com online store,
• receive individual discounts,
• participate in promotions and competitions,
• review products without the need for moderation and approval on our part,
• keep detailed statistics of their activities in the Seller's system,
After registration, the Customer will receive a link to the account activation website at the e-mail address provided. Activation allows you to log in to the system.
In order to register correctly, you must fill in all fields of the registration form containing the data required to create a user account.
By registering a user account, the Customer:
• consents to the inclusion of their contact details in the onyx4you.com database and to the processing of such data in accordance with the Personal Data Protection Act of May 10, 2018 (Journal of Laws of 2018, item 1000). This data will be used solely for the purposes of:
• the performance of the contract by the Seller,
• providing information about new products, services, and promotions offered by the onyx4you.com online store,
• should accept the provisions of the Terms and Conditions of Sale of the onyx4you.com online store,
• may consent to receiving information about promotions and new products.
Providing personal data in the registration form is voluntary, although necessary for the performance of the sales contract concluded with the Seller. The customer has the right to access and correct their data.
In order to purchase products in the onyx4you.com online store, click on the selected product and place an order.
The validity period of the order is 2 days. In the absence of payment (applies to orders paid in advance), the order is automatically canceled after this period.
IV. Delivery
1. Deliveries of products ordered in the onyx4you.com Online Store are made within the territory of the Republic of Poland.
2. For orders with delivery outside the territory of the Republic of Poland, please contact us at contact@onyx4you.com
3. Purchased products are delivered according to the Customer's wishes via InPost, UPS, or Poczta Polska (Polish Post).

5. The term of the sales contract is from 1 to 10 business days.
6. In the case of delivery by courier, receipt of the shipment requires a written receipt. Upon delivery of the goods to the Customer, the ownership of the goods, rights, and all risks associated with the possession and use of the goods, in particular the risk of loss or damage, are transferred to the Customer.
7. The Seller does not accept any cash on delivery shipments.
The photos on the Seller's website are for illustrative purposes only, and differences between the photos and the actual appearance of the product cannot be used as grounds for a complaint.
V. Claims procedure

2. The basis and scope of the Seller's liability towards the Customer who is a Consumer under the warranty covering physical and legal defects are specified in the Civil Code of April 23, 1964 (Journal of Laws No. 16, item 93, as amended).
3. Notifications of defects in the Product and the submission of the relevant request may be made by e-mail to the following address: contact@onyx4you.com or in writing to the following address: ul. Racławicka 44, 34-125 Sułkowice
4. The above e-mail should contain as much information and circumstances as possible regarding the subject of the complaint, in particular the type and date of the irregularity and contact details. The information provided will significantly facilitate and speed up the processing of the complaint by the Seller.
5. If necessary for the assessment of physical defects of the Product, after prior contact with the Seller, it should be delivered to the following address: ul. Racławicka 44, 34-125 Sułkowice.
6. The Seller will respond to the Customer's request immediately, no later than within 14 days. The response to the complaint will be sent to the e-mail address provided by the Customer or in another manner specified by the Customer.
7. In the case of a complaint by a Customer who is a Consumer, failure to consider the complaint within 14 days shall be tantamount to its acceptance.
8. In connection with a complaint by a Customer who is a Consumer, the Seller shall cover the costs of collection, delivery, and replacement of the Product with one free of defects.
9. Complaints related to the provision of Electronic Services by the Service Provider:
10. Complaints related to the provision of Electronic Services via the Store may be submitted by the Service Recipient via e-mail to the following address: contact@onyx4you.com. The above e-mail should contain as much information and circumstances as possible regarding the subject of the complaint, in particular the type and date of the irregularity and contact details. The information provided will significantly facilitate and speed up the consideration of the complaint by the Service Provider.
11. The Service Provider shall consider the complaint immediately, no later than within 14 days.
12. The Service Provider's response to the complaint shall be sent to the Service Recipient's e-mail address provided in the complaint form or in another manner specified by the Service Recipient.
VI. Right to withdraw from the contract
1. A customer who has concluded a distance contract may withdraw from it in writing without giving any reason within 14 days from the date of delivery of the goods. The statement of withdrawal from the contract should be sent to the address of the registered office of onyx4you.com (indicated in Title I, point 1 of these Terms and Conditions). Onyx4you.com also allows the statement to be submitted electronically to the following e-mail address: contact@onyx4you.com.
2. The 14-day period is counted from the date of delivery of the goods, understood as the taking possession of the goods by the consumer or a third party other than the carrier indicated by the consumer.
3. The goods should be returned immediately after submitting the declaration of withdrawal from the contract, no later than within 14 days, in an unchanged condition.
4. The costs of direct return (return) of the goods to the Seller in connection with the withdrawal from the contract without giving a reason within 14 days from the date of delivery shall be borne by the Customer.
5. Raw material specifications: Any roughness or imperfections on the surface, as well as local differences in the shades of the onyx mineral and wooden base, are due to the specific nature of the raw materials, i.e., natural minerals and wood, and are a natural phenomenon. Each lamp made of natural mineral has a unique and unrepeatable structure, and the wooden base has a visible structure of grain, knots, and discoloration, which makes the product unique and unrepeatable. An uneven surface is not a product defect. The appearance and aesthetics of the lamps are the manufacturer's intended goal. Therefore, the Seller does not consider products with slight differences in color intensity or shape differences in lamps and candlesticks to be defective and does not accept complaints on this basis. We leave it up to the customer to decide and assess whether products in the natural mineral style with the addition of wood will be suitable for their interior.
